Terms and conditions of sale
SUBJECT
These general terms and conditions of sale (hereinafter referred to as ‘GTCS’) govern the rights and obligations of the parties in the context of sales offered by Torque Drift School (hereinafter referred to as ‘Torque’), an entity developed and managed by ProRace SAS, whose registered office is at 11 Impasse Gutenberg, 38110 Rochetoirin, France.
GENERAL PRINCIPLE
These GCS govern the rights and obligations of the parties in the context of sales offered by Torque Drift School (hereinafter ‘Torque’), an entity developed and managed by ProRace SAS, whose registered office is at 11 Impasse Gutenberg, 38110 Rochetoirin, France.
CONFIRMATION
Following your order, Torque will acknowledge receipt by sending you an order confirmation e-mail including a summary of your order, its number and these GTC, and will definitively validate your order by sending you an order validation e-mail. The sales contract is deemed to have been concluded when the purchase is confirmed.
RIGHT OF WITHDRAWAL
The provisions of articles L. 121-18, L. 121-19, L. 121-20 and L. 121-20-1 of the Consumer Code do not apply to contracts for the following purposes :

The supply of everyday consumer goods to the consumer's home or workplace by distributors making frequent and regular rounds.

The provision of accommodation, transport, catering and leisure services, which must be provided on a specific date or at a specific time.
However, the provisions of articles L. 121-18 and L. 121-19 are applicable to contracts concluded by electronic means when their purpose is to provide the services mentioned in point 2.
CANCELLATION POLICY
If the customer cancels his/her participation in the course, he/she will be reimbursed according to the following scale:

Cancellation between 60 and 16 calendar days before the course: 100%.

Cancellation between 15 and 8 calendar days before the course: 60%.

Cancellation between 7 and 3 calendar days before the course: 0%.

Absence from class: 0%.
All cancellations must be made in writing (letter or e-mail). The date of receipt of the cancellation (between 08:00 and 17:00) determines the calculation of the refund rate. Unless a medical certificate stating the inability to drive or attend the course is presented within 7 days of the missed course, the course will be billed.
Any refund of a registration paid for by bank card is subject to a fee of up to €10, as the online payment organisation does not refund fees in the event of a refund.
The course is transferable and can be taken by another person to avoid penalties.
In the event of cancellation of a course by Torque for reasons of force majeure (COVID, adverse weather conditions: negative temperatures, snow, storms), the customer will benefit exclusively from a rescheduling.
CUSTOMER RESPONSIBILITY
The customer undertakes to provide valid information when placing the order and to hold a valid driving licence (including foreign licences) or a recognised FFSA licence. They must comply with Torque's safety instructions and internal regulations. The customer becomes responsible for the vehicles and facilities as soon as they take the wheel; this transfer implies the transfer of risks.
In the event of dangerous driving, wilful misconduct or failure to comply with safety rules, the pilot instructor may interrupt the service without refund.
The customer will not be held responsible for any damage to the course vehicle if the safety instructions are followed. Any damage due to normal wear and tear is the responsibility of Torque. The customer is liable for damage caused by incorrect downshifting or deliberate collision with an obstacle.
Alcohol: no tolerance is accepted. Torque reserves the right to carry out random checks. A positive test will result in the cancellation of the course, which will be deemed to have taken place and will not be reimbursed.
RESPONSIBILITY OF THE ORGANISER
Under no circumstances will Torque be liable for indirect material or physical damage, loss of profit, or any other material damage arising from the services.
Torque declares that it has the necessary insurance to cover damage to vehicles, provided that the customer complies with the safety instructions.
DATA PROTECTION
ProRace SAS acknowledges the confidentiality of the information provided by the customer when ordering and undertakes not to disclose this information to third parties. Customers have the right to access and rectify their personal data.
AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS
ProRace SAS reserves the right to modify these GTC. The version in force at the time of the order will apply.
APPLICABLE LAW AND PLACE OF JURISDICTION
French law applies and the place of jurisdiction is Tassin-la-Demi-Lune.
